
One of the primary tenets of the First Amendment of the US Constitution is the right to “peacefully assemble,” re. the right to protest. It has been an anchor in the right to free speech and has been presented to us as one of the underlying differences between the US and other countries. The fact that we allow our citizens to protest is supposed to be one of the things that make us better than anyone else.
Well, as of Monday, April 15, 2024, you can pretty much toss that one in the can. The Supreme Court of the United States, in its endless bafflement, ruled against the First Amendment in rejecting an appeal from DeRay Mckesson in a case that stems from a 2016 protest over the police killing of a Black man in Baton Rouge. What the court appears to have said is that the person who organizes a protest is responsible for the actions of the people participating in the protest.
There are some caveats. First, Associate Justice Sonia Sotomayor warned lower courts to “not read anything” into the decision. In other words, by rejecting this particular case the court does not rule out the possibility that it might take up the full matter at a later date. Second, it is important to realize that in rejecting the case, justices did not hear full arguments on the matter, which would give the matter the weight of precedence in subsequent cases.
However, the decision is still troubling. The decision will most definitely hold some influence over lower courts. Yet another Pandora’s Box has been opened (how many of those damn boxes does Pandora have?).
What’s all the fuss, Gus? Back in 2016 (remember 2016?), a man named DeRay Mckesson organized a protest in Louisiana after police killed a black man in Baton Rouge. During that protest, someone unidentified threw a “rock-like object” and it hit an officer. Since the rock thrower couldn’t be identified, the officer, hiding behind the moniker John Doe, decided to sue Mckesson for not controlling the protest he instigated. The initial federal court threw out the suit, which was, unquestionably in my opinion, the correct decision. However, the 5th U.S. Circuit Court of Appeals ruled 2-1 to pick it back up because Mckesson didn’t lead the protest onto the highway, resulting in a standoff with police and the injury to the officer.
If this is going to be the case, someone let that former president know that he is now on the hook for every action taken by protestors on January 6, since he organized that melee. It’s all his fault.
More seriously, though, we have to look at this decision as a warning to anyone who might consider organizing future protests. How the fuck are you supposed to “control” a crowd who is righteously angry? Do you remember what was going on in 2016? We were finally standing up to the fact that people of color were being indiscriminately murdered by police! There was every reason in the world to protest and every reason to exhibit anger as part of those protests.
So, what happens when the Supreme Court does something really stupid like take away the right to gender-affirming care for everyone, not just trans kids in Ohio? Is that topic safe to protest? Can we get everyone on the highway? What happens this fall when Republican Governors mobilize the National Guard because they don’t like the way the elections go? Is that going to be safe to protest? What about when the Supreme Court overturns the January 6 convictions on a technicality? Are we safe to protest that fatality of justice?
The nature of protests is that the more people participating, the more seriously the protest is taken. However, the more people protesting, the more likely it is that someone is going to misbehave, often out of anger at a gross miscarriage of justice and the fear that their opinion is not being heard by those in power. The more government leaders attempt to shut down protests, as they did the Black Lives Matter protests of 2016, the more angry protestors are going to be. If elected leaders aren’t going to pay attention to their constituents through the manners prescribed by law, then protestors are more likely to resort to more extreme manners of communication.
Did we learn nothing in history class?
We need to protect the right to protest. When those we’ve elected to uphold the law take it upon themselves to ignore the law, protest may become the only way we have of solving the problem.

All these concepts of an ideal world stem from our basic desire to want everything to be fair while simultaneously wanting our own situation to be just a bit better than everyone around us. We keep searching for a “level playing field” without any significant regard to exactly what happens when that field holds no tilt in one direction or another. The metaphor from which we begin is flawed, thereby flawing all the theories we build upon it.
For well over 2,00 years now, the crux of Western Civilization has been a desire to be fair, at least to the extent of however “fair” was defined by the people in charge. Go all the way back to ancient Greece, somewhere around 750 BCE or so. This is the general starting point from whence Socratic thought emerged. Here are the beginnings of our sense of what government, economics, and society should be. Plato has not yet written Republic, but the foundation leading to that tome is being built.
The Internet held out the opportunity to make society better by removing all the barriers to entry for publication. Anyone can have a web page and say anything on it that they damn-well please. You believe the earth is flat? Create a website that supports your ignorance and it can compete right up there with all the science stating that you are wrong. Want to sell “essential” snake-oil to gullible cancer patients desperate for a cure? The Internet allows one to do that with practically no interference or oversight. Nothing can “level the playing field” quite like the Internet.
All of these challenges to our relatively young culture are based in attempts to level a playing field to such an extreme that we’ve opened the door to absolute pandemonium in the name of freedom. Again, this situation was not unforeseeable long before it happened. Plato, in Republic, warns: “Excess of liberty, whether it lies in state or individuals, seems only to pass into excess of slavery.” There is such a thing as too much freedom. We have proven that we do not have the ability to restrain ourselves, therefore, the restraint must be imposed upon us if we are to survive.
Pulling up weeds is difficult and hard work. Their root systems are deep and expansive. Pulling them up can often leave huge holes in the yard. Mowing over them is not sufficient; they grow right back while their root system grows increasingly invasive. Once weeds have been allowed in a yard, even just a few, removing them is a long and painful chore.
What, then, is Injustice? We cannot define it as the absence of Justice for there is ground wherein neither Justice nor Injustice occurs. Rather, Injustice is that which acts or exists in such a way as to prohibit Justice on the part of another. For example, insomuch as healthcare is necessary for one to achieve Justice, the denial of healthcare would be Injustice. Forcing the homosexual to adhere to laws specifically designed to favor heterosexuals is Injustice. Imposing laws based upon the tenets of one mythology onto holders of a different mythology or no mythology is Injustice. Denying one’s ability to be is the greatest Injustice of all.
Understand, please, that simply taking a test and passing is no real measure of knowledge obtained nor the ability to use that information to reason one’s way through problems. No small amount of irony exists that our current society has the most open access to information ever, but at the same time may hold the least ability to reason than any generation in the past 300 years. Access to information does not equate to knowledge and the ability to obtain knowledge does not guarantee wisdom. Void of a broad repository of wisdom spread around the world, humanity lunges head-first into a state of decline leading to its own extinction.
Weeds have a way of getting in and taking root no matter how often we might try to eliminate them. One of those weeds against which people of reason have fought for millennia is that element which attempts to deny Truth or warp a truth to fit their own agenda. The weed even dogged ancient Greece, prompting Plato to make a statement that seems frighteningly accurate for the contemporary situation:
Greed. Selfishness. Corruption. Slavery. I’m not likely to make many friends when I say these are the basic underpinnings of Western Capitalism as it currently exists. Greed and selfishness are the drivers. Corruption is the methodology. Slavery is the means. Remove even one of those aspects and Capitalism morphs into something different, something more equitable and less damaging to humanity.
In Apology, Plato writes, “The State is like a great and noble steed who is tardy in his motions owing to his very size, and requires to be stirred into life. I am that gadfly which God has given the State and all day long and in all places am always fastening upon you, arousing and persuading and reproaching you. You will not easily find another like me.”
There is a point in this prolonged metaphor where pulling out a lawn mower isn’t sufficient. Have you ever tried mowing a lawn with knee-high weeds? It’s not possible. The thick overgrowth chokes the mower. One has to go through with a scythe and/or a weed trimmer and knock down the overgrowth before mowing. I’ve seen a few extreme instances, open fields with no buildings involved, where the tangle was so consuming and impossible that the only option was to set fire the whole thing, plow it under and start over.
In the grander scheme of things, I know nothing. We’ve linked to scholarly work by people with far greater wisdom and knowledge than I will ever have. I would hope that you might follow those links and take advantage of the public access to such wisdom, but history indicates you probably won’t be bothered. In fact, it is much more likely that if you have made it this far into this article, you didn’t actually read; you skimmed, hopped over paragraphs rather than taking the time to consume what is ultimately going to be roughly 16,000 words. Tik, Tik, Boom.
As easy as it is to blame governments for all our problems, the glaring truth is that much of the responsibility for what we currently experience is our own fault. I know, that doesn’t sound like a friendly way of starting the morning, but the truth is that what I’m seeing between the various ugly and disgusting headlines is a clear message that we could have stopped a lot of this but chose to go ahead anyway. We choose who runs for office. We choose how we spend our money. We choose how we spend our time. When we do not make responsible choices, we pay the consequences and, to a large extent, that is what is happening right now.
A shocking tuberculosis outbreak in the Kansas City, Kansas area is frightening, but it can be easy to stop if people in the area make the right choices. Washing your hands, covering your mouth when you cough, and staying home when you’re sick are all things that keep TB at a minimum. TB is one of the world’s biggest killers, though, and winter is a great time for it to spread. Make wise choices.
Reading skills among US children are diminishing, and their math scores are horrible. Blame the schools all you want, but it’s mom and dad who are responsible for setting up a child’s brain to read. We ‘read’ to infants with picture books because it helps develop an association in their brains between symbols and words. As they get older, their brains develop a deeper understanding of the relationship between letters, numbers, and the world around them. All five of my kids were reading at some level before they started kindergarten (sometimes creating difficulty in an unprepared classroom). Parents set their kids up for success or failure on this front and we have to accept the responsibility for the outcome.
Then, we discover that the ‘Doomsday Clock’ broke a two-year stagnation and moved a second closer to human annihilation. One of the primary reasons for the move is rhetoric, the spreading of misinformation regarding who is going to do what to whom. How we perceive someone else’s willingness to engage in nuclear battle is based largely on the talk that is perpetuated through social media. The spread of disease and our lack of cooperation in global medicine also increase the chances of a pandemic wiping out large numbers of people. These are all things that we control and can adjust.
No, I’m not dismissing the fact that the current US administration is pure evil and that Republican governors are making the situation worse by forcing local law enforcement to cooperate with federal thugs. We need to be up in arms about the signing of the Laken Riley Act as it allows people to be detained and deported without a trial, in violation of the Constitution. Action needs to be taken to stop the use of military bases in Colorado as detention camps. And don’t even get me started on the dismantling of DEI protections. We need to be willing to go to war over that one.
I’m also concerned that the top headline from Reuters this morning was ‘Alibaba releases AI model it says surpasses DeepSeek‘ and right under that was ‘Dutch chip firm ASML sees flood of orders amid AI boom‘. Despite all the billions of dollars in investment, the US is losing the race on AI, which means that not only are our kids less intelligent but so are our computers. DeepSeek’s new AI chatbot and ChatGPT answer sensitive questions about China differently, among other factors. AI developers have the ability to rewrite what we know about history, skewing our view of the entire world.
Today, we can ill afford to put our heads in the sand and ignore everything going on around us. We are responsible. We are also response able. We are not helpless. We are not without voices. We are not without agency.
Together, let’s fix this.
